These Terms of Service (“Terms”) apply to your use of the Fleety mobile application and website (together, the “Services”), provided by Fleety Inc. (“Fleety,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
Fleety provides public transit information and trip-planning tools, which may include schedules, arrival predictions, vehicle locations, route details, maps, service alerts, and related features. Some features may be free; others may require a paid subscription.
You must follow applicable laws when using the Services. If you are under the age of majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian.
2. Transit information and safe use
Transit information may come from public agencies and other third-party sources. It can be delayed, incomplete, unavailable, or inaccurate, and service conditions can change without notice. Fleety does not operate or control transit services and does not guarantee any schedule, arrival time, route, vehicle location, or service alert.
Use your judgment, check important information with the relevant transit agency, and allow enough time for your trip. The Services are informational only and are not an emergency service. Do not use your device or the Services in a way that distracts you while driving, walking, cycling, or boarding transit; pay attention to your surroundings and follow official signs and instructions.
3. Acceptable use
You agree not to misuse the Services. In particular, you must not:
- use the Services unlawfully or to harm, threaten, or interfere with another person;
- probe, disrupt, overload, or attempt to gain unauthorized access to the Services or related systems;
- copy, modify, distribute, sell, or commercially exploit the Services except as allowed by law or with our written permission; or
- reverse engineer or attempt to extract source code, except where applicable law does not allow that restriction.
4. Fleety PLUS and in-app purchases
Fleety offers in-app purchases, including Fleety PLUS subscription plans where available. The products, billing period, price, currency, taxes, and any introductory offer will be shown in the app or store checkout before you confirm a purchase. Prices and available plans may vary by country, platform, and time.
When you buy a subscription through Apple or Google, the applicable store processes the payment and manages the subscription. A recurring subscription renews automatically for the period shown at checkout unless you cancel it through your Apple Account or Google Play account before the next renewal. The store charges your payment method at the price then in effect, subject to its billing terms. Canceling generally stops future renewals; access to paid features continues through the current paid period as determined by the store and applicable law.
To manage or cancel an Apple subscription, use Apple’s subscription settings. To manage or cancel a Google Play subscription, use Google Play subscriptions. Removing the app from your device does not cancel a subscription. Refund requests for store purchases must be made through the store and are subject to its policies and applicable law.
For Apple App Store downloads, Apple’s Licensed Application End User License Agreement also applies. If a term in that agreement conflicts with these Terms about your license to the Apple-distributed app, Apple’s agreement controls for that issue.
5. Ownership and third-party services
The Services, including their design, software, text, graphics, and branding, are owned by Fleety or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose, subject to these Terms.
The Services may link to or rely on third-party services, maps, data, or platforms. Those third parties operate under their own terms and policies. Fleety is not responsible for third-party services or content.
6. Availability and changes
We may update, suspend, or discontinue any part of the Services. We will provide notice where required by law. We do not promise that the Services will always be available, uninterrupted, secure, or error-free.
7. Disclaimers and limits of liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. This includes warranties of accuracy, availability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Fleety and its directors, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill arising from or related to your use of the Services. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including rights you have under applicable consumer-protection laws.
8. Suspension and termination
You may stop using the Services at any time. We may suspend or end your access if we reasonably believe you have materially violated these Terms, if necessary to protect the Services or others, or where required by law. Sections that by their nature should continue after termination will remain in effect.
9. Changes to these Terms
We may revise these Terms from time to time. We will post the revised Terms here and update the date above. If a change materially affects your rights, we will provide additional notice when required by law. Your continued use of the Services after revised Terms take effect means you accept them.
10. Governing law
These Terms are governed by the laws of Ontario and the applicable laws of Canada, without regard to conflict-of-law rules. The courts located in Ontario will have jurisdiction over disputes relating to these Terms, subject to any mandatory rights or protections that apply where you live.
